What is racial inequality? Racial inequality is discrepancies in the opportunities and treatment of people based solely on their race. Racial inequality is a serious issue that is often discussed in the American criminal justice system. Although racial discrimination is present in the criminal justice system, some people use the words inequality, discrimination, racism, and profiling loosely and do not understand how truly complex it is to prove that there actually is racial inequality present in the criminal justice system. Daniel P Mears, Joshua C. Cochran, and Andrea M. Lindsey article Offending and Racial and Ethnic Disparities in Criminal Justice: A Conceptual Framework for Guiding Theory and Research and Informing Policy illustrates†¦show more content†¦The three terms are difference, disproportionality, and disparity. According to the article, difference refers to the â€Å"unequal absolute amounts of racial or ethnic offending, arrests, convictions, prison sentences, and the like,† (Mears, Cochran, Lindsey, 2015). The article points out that not all crimes and offenders are the same so just because there are differences in race and sentencing doesn’t necessarily mean that racial inequality is present. The term disproportionality is defined as â€Å"racial or ethnic differences that are greater than what would be expected given the group population sizes among those for whom a given outcome is possible,† (Mears et al, 2015). Disproportionality can be present in many stages of the criminal justice process. When disproportionality is present red flags should be raised but just because there is disproportionality that still doesn’t mean there is enough evidence to prove that discrimination is present. Disparity is the involvement of â€Å"any disproportionality attributab le to overt or covert, or intended or unintended, discrimination against minorities,† (Blank Citro, 2004). In simple terms disparity is unfairness. In cases where just disparity is present that does not mean that discrimination is in place.
